Agreement to Terms

By accessing or using NeuroAlignWithAbe coaching services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

Services Description

NeuroAlignWithAbe provides online fitness coaching, corrective exercise programming, nutrition guidance, and ADHD-focused support services. Our Services include:

  • Monthly coaching subscriptions (Standard and Premium packages)
  • Single assessment sessions
  • Video check-ins and form analysis
  • Customized workout programming
  • Nutrition guidance and meal planning
  • ADHD coaching integration

Client Responsibilities

Health and Safety

  • You are responsible for consulting with a qualified healthcare provider before beginning any fitness program
  • You agree to disclose any relevant medical conditions, injuries, or limitations during your assessment
  • You understand that our coaching does not replace medical advice or treatment
  • You assume all risks associated with participating in physical exercise

Honest Communication

  • Provide accurate information about your fitness level, health status, and goals
  • Communicate any discomfort, pain, or concerns immediately
  • Inform your coach of any changes to your health status or medications

Payment Terms

Pricing and Billing

  • All prices are listed in CAD and may be subject to change with 30 days notice
  • Monthly subscriptions are billed on a recurring monthly basis
  • Payment is processed through Wise or other authorized payment processors
  • You are responsible for maintaining valid payment information

Refund Policy

  • Single Assessment: Refundable up to 24 hours before scheduled appointment
  • Monthly Subscriptions: No refunds for partial months. You may cancel at any time, and service continues until the end of your billing period
  • Extenuating Circumstances: Refunds may be considered on a case-by-case basis for medical emergencies or other exceptional situations

Cancellation Policy

  • You may cancel your monthly subscription at any time by providing 7 days written notice via email
  • Cancellations take effect at the end of your current billing period
  • No refunds are provided for unused sessions within a billing period
  • We reserve the right to terminate Services for violation of these Terms or inappropriate conduct

Rescheduling and Missed Sessions

  • Live 1:1 video calls may be rescheduled with at least 24 hours notice
  • Missed appointments without notice will be counted as completed sessions
  • Video check-ins and asynchronous communication are not time-sensitive and do not require rescheduling

Intellectual Property

Your License

When you receive custom workout programs, meal plans, or other materials from NeuroAlignWithAbe, you are granted a personal, non-transferable license to use them for your own fitness goals only.

Restrictions

You may not:

  • Share, distribute, or resell your custom programs to others
  • Use our coaching materials for commercial purposes
  • Copy, reproduce, or create derivative works from our proprietary content
  • Remove copyright or ownership notices from any materials

User Content

When you submit videos, photos, or other content for form analysis:

  • You retain ownership of your content
  • You grant us permission to use your content solely for providing coaching services
  • We will not share your content publicly without your explicit written consent
  • We may use anonymized data for improving our services

Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

  • We collect only the information necessary to provide our Services
  • Your health information is treated as confidential
  • We do not sell or share your personal data with third parties for marketing purposes
  • You have the right to request access to or deletion of your personal data

Not Medical Advice

IMPORTANT: NeuroAlignWithAbe coaching services are NOT a substitute for medical advice, diagnosis, or treatment. Our coaches are certified fitness professionals, not medical doctors or licensed therapists. Always consult with your physician before starting any exercise or nutrition program.

ADHD Coaching Clarification

Our ADHD coaching integration focuses on executive function support, habit formation, and systems design related to fitness and wellness. We do not diagnose ADHD, prescribe medication, or provide clinical mental health treatment.

Results Disclaimer

Individual results vary. While we provide evidence-based programming and personalized support, we cannot guarantee specific outcomes. Your results depend on many factors including consistency, effort, genetics, and individual circumstances.

Limitation of Liability

To the fullest extent permitted by law, NeuroAlignWithAbe and its coaches shall not be liable for:

  • Any injuries, damages, or health complications arising from participation in our programs
  • Any indirect, incidental, special, or consequential damages
  • Loss of data, profits, or business opportunities
  • Any damages exceeding the amount you paid for Services in the preceding 3 months

Code of Conduct

We are committed to providing a safe, respectful, and supportive coaching environment. You agree to:

  • Treat your coach and all staff with respect and professionalism
  • Communicate in a constructive and appropriate manner
  • Not engage in harassment, discrimination, or abusive behavior
  • Not share others' personal information without consent

We reserve the right to terminate Services immediately for violations of this Code of Conduct.

Modifications to Terms

We may update these Terms from time to time. When we make material changes:

  • We will notify you via email at least 14 days before changes take effect
  • The "Last Updated" date at the top will be revised
  • Continued use of Services after changes take effect constitutes acceptance
  • If you do not agree to changes, you may cancel your subscription

Governing Law and Disputes

  • These Terms are governed by the laws of Canada
  • Any disputes will be resolved through good-faith negotiation first
  • If negotiation fails, disputes will be handled in accordance with Canadian law

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and NeuroAlignWithAbe regarding our Services.
